Choosedirect.com can place an order and hold an in-stock item with your non-refundable $500.00 Initial Installment. Production and shipping of a custom order or in-stock order may be delayed if the balance is not received in 5 business days from the order date. Choosedirect.com reserves the right to cancel the order and retain the initial installment if the customer does not pay in full within 30 days. ChooseDirect.com makes every effort to consult with our customers in the selection of their hot tub or sauna purchase in order to select the best configuration for their needs. All in-stock items are immediately held for our customers and custom orders are made with features tailored to the customer’s needs and therefore cannot be cancelled. Should you need to cancel an order, ChooseDirect.com reserves the right to retain the initial production installment collected and any additional installment payments collected toward the purchase. In addition to our policy stated on our site, your signature further affirms your acceptance of this order and any additional disclosures in the invoice.
Each manufacturer of hot tubs have their own electrical certifications. The customer is responsible for ordering a hot tub that meets their certifications for their region.
Upon receiving your hot tub it will arrive in its full packaging and you must sign off you accept the product's condition. After signing the acceptance of the hot tub, you have an additional 24 hours to report (to ChooseDirect.com) any cosmetic or physical damages to your product which you may have noticed after you remove the packaging of your product. Outside of that period of 24 hours, ChooseDirect.com cannot accept the claim and will not be liable for such damages, as we have found there are many accident's with the customer moving the hot tub from the curbside to their yards (ChooseDirect.com responsibility is to get the product to the curbside).
Except for the case of Island Escape Spas, “ChooseDirect.com” does not warranty other manufacturer's spas directly. Warranty coverage is covered only and directly with the manufacture. Any default by the manufacturer on warranty is not a responsibility of ChooseDirect.com as it does not have any warranty responsibilities for this product. Return policy: No returns. All issues are remedied by the warranty of the manufacturers.
ChooseHotTubs Direct.com attempts to provide current and accurate information on its web sites, email and telephone communications. Choose HotTubsDirect.com does not, however, warrant that this information is correct, totally accurate, or complete. Information communicated by ChooseHotTubsDirect.com is not a contract and should not be treated as such. The only remedy of a customer acting on incorrect information is to request a cancellation of the order placed as a result of this incorrect information.
You agree that the laws of the state of California, without regard to principles of conflict of laws, will govern these Terms of Service and any dispute of any sort that might arise between you and the ChooseHot TubsDirect.com or its affiliates.
Pursuant to the terms of service, you agree to submit all disputes, claims, causes of action, under California state law to arbitration before Jams in Contra Costa County, California. You further agree that ll claims, causes of action, disputes, and/or remedies deemed arbitrable under California laws shall be adjudicated first to judgement. All other incidences that are inarbitrable under California law shall be adjudicated, if necessary, after any arbitration proceeding and must be brought in the Superior Court of Contra Costa, California.
